Who will file the court action?
The administrative team in this court action can help individuals in the action to file the paperwork. Depending on the type of action initiated (either appeal or class action), it will be a single applicant with all others as parties or signatories, or as each person as a claimant with a lead plaintiff.
What is needed from you?
You will need to join the Whatsapp group/website and sign some documentation that will include providing your name, address, email, social media, details of how and why you are joining this fight.
What to expect
Regular communications via Whatsapp/website/email. Activist activities may include creating flyers, distributing flyers, connecting to people online or other forums and helping grown the group. When the group is sufficiently large, we may invite people to a Town Hall or other in person meeting groups across key centres in Queensland.
Court action
Essentially the battle will be a paper war, where there will be regular directions hearings listed as well as submission deadlines. All events will be communicated to the group, as well as opinions sought.
Our experience
We are not lawyers and cannot provide any legal guidance. We can educate the people on the law, principles of law, the Constitution, legislation and how Government operates as well as the procedures of the Court. If you need legal advice, please consult a lawyer.
Costs
The costs of such a matter can be large when considering law firms and costs of the court if the action were to fail and costs awarded against us. With regards to law firms, there are no law firms connected to this action. There may be from time to time requests to make small donations to ensure the smooth running of the administration of the group, but otherwise there will be no other legal fees. With regards to costs, typical at the 1st stage of proceedings where the matter has been filed and the respondents (the State) have agreed to appear, costs are generally around 20k-30k. This is why no court action will be initiated until a sufficiently large group are signed on, essentially indemnifying the action against the immoral and unethical threat of costs as a reason to abandon the court action. For $1 million dollar costs, for a group of 20k is $50 per person. Well worth the attempt to seek justice.
Activism
We need you to connect to as many people as you can. Scan news articles that talked about people that were unjustly fired or who had injuries or who have joined our side. Talk with people. Email people. On social media, connect with people. Go over lists. Communicate with others in the list. Report back your findings. For significant findings, report to Scott, Amanda or myself. Lets build this thing. We are all the Erin Brockovich’s of our time.
Time Frames
Once enough people are willing to sign on, the application process will take a few weeks. Once filed, typically a directions hearing will be scheduled and the process begins. A trial may be scheduled anywhere between 6 months and 12 months into the future, but nothing is set in stone.
